Terms of Service

1. Acceptance of Terms
By accessing or using the Partython AI platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms. If you do not agree, you may not use the Service.
2. Description of Service
Partython AI provides a multi-tenant, white-label conversational AI platform that enables businesses to deploy AI-powered agents across messaging channels including WhatsApp, Instagram, Messenger, Telegram, and web chat. The Service includes AI agent management, knowledge base (Brain Engine), smart LLM routing, analytics, and related tools.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorized access. We reserve the right to suspend accounts that violate these terms.
4. Acceptable Use
You agree not to use the Service to: (a) violate any applicable law or regulation; (b) transmit harmful, threatening, or harassing content; (c) impersonate any person or entity; (d) interfere with or disrupt the Service or its infrastructure; (e) attempt to gain unauthorized access to other accounts or systems; (f) use the AI agents to generate misleading, deceptive, or fraudulent content; or (g) resell access to the Service without authorization under a white-label agreement.
5. Intellectual Property
The Service, including its design, features, code, and documentation, is owned by Partython Private Limited and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service. Content you create using the platform (agent configurations, knowledge base content, conversation data) remains your property. White-label customers retain full ownership of their branded deployments.
6. Pricing & Payments
Subscription fees are billed monthly or annually as selected during signup. All fees are in USD unless otherwise stated. We reserve the right to change pricing with 30 days' written notice. Failed payments may result in service suspension after a 7-day grace period. Refunds are governed by our separate Refund Policy.
7. Service Level & Uptime
We target 99.9% platform uptime, measured monthly. Scheduled maintenance windows are communicated at least 48 hours in advance and excluded from uptime calculations. Enterprise customers may negotiate custom SLAs. We are not liable for downtime caused by third-party providers, force majeure events, or customer-side issues.
8. Data & Privacy
Our handling of personal data is governed by our Privacy Policy. You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining necessary consents from your end users. We act as a data processor on your behalf for conversation data processed through the platform.
9. Limitation of Liability
To the maximum extent permitted by law, Partython Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability for any claim arising from these terms shall not exceed the fees you paid in the 12 months preceding the claim.
10. Termination
Either party may terminate the agreement with 30 days' written notice. We may terminate immediately if you breach these terms. Upon termination, your access to the Service will cease. You may request an export of your data within 30 days of termination, after which it will be permanently deleted.
11. Governing Law
These terms are governed by the laws of India. Any disputes shall be resolved through arbitration in New Delhi, India, under the Arbitration and Conciliation Act, 1996. If arbitration is not applicable, the courts of New Delhi shall have exclusive jurisdiction.
12. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance. If you disagree with changes, you may terminate your account before they take effect.
